Instructions on how to claim and information about the Wine Packages form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. This offer not valid in conjunction with any other offer.
Claims are only open to Australian residents aged 18 years or over (“Eligible Customers”).
Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to claim. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
The purchase period commences on 01/08/2020 and ends at 11:59pm AEST on 31/08/2020 (“Purchase Period”). The claim period opens on 01/08/2020 and closes at 11:59pm AEST on 30/09/2020 (“Claim Period”).
To be eligible to claim, individuals must spend, in a single transaction, a minimum of $2,000 on two (2) or more selected cooking appliances, as listed in Annexure A (“Eligible Cooking Appliances”), from a Participating Brand at a Participating Retailer (as defined below) during the Purchase Period (“Eligible Purchase”). The Eligible Purchase must be paid in full during the Purchase Period. The eligible cooking appliances must be purchased for retail personal use only, and any commercial purchases will be ineligible to claim.
A “Participating Brand” means one of the following:
Smeg (Classic and Victoria cooking ranges only).
A “Participating Retailer” means one of the following:
Betta Home Living;
Whitfords Home Appliances;
L&M Gold Star;
Turner's Home Appliances;
David Barke Appliances;
Reilly's Home Appliances Bendigo;
Newtons The Home of Prestige Appliances;
Brisbane Appliance Sales; and
Adelaide Appliance Gallery
To make a claim, Eligible Customers who make an Eligible Purchase (“Eligible Claimants”) must then complete the following steps during the Claim Period:
Input the requested details (including their full name, date of birth, mailing address, valid email address, model number of the eligible models purchased, the date the Eligible Purchase was made and the Participating Retailer), upload a copy of the purchase receipt for the Eligible Purchase that has been paid in full; and then
Submit the fully completed online claim form.
Eligible Claimants will then receive an email from the Promoter confirming that their claim has been submitted and is subject to verification.
Once the claim has been validated, the verified eligible claimant will:
Receive an email from the promoter with a Promo Code (“Promo Code”) which will entitle the Eligible Claimant to select and redeem one Wine Package from Treasury Wine Estates Vintners Limited ABN 55 004 094 599 (“TWE”)
Select their preferred wine package from the options available (“Wine Package”);
Confirm that they are over 18 years of age;
Accept the Terms and Conditions; and
Enter and apply their Promo Code.
Once an Eligible Claimant redeems their Promo Code, their selected Wine Package will be delivered via Australia Post to the address nominated by the claimant (at no additional cost to the Eligible Claimant) within thirty (30) days, except in the cases of supply and delivery to rural or remote areas of Australia, in which case the selected wine package will be delivered to the claimant within six (6) weeks after redemption.
In the event a delivery of a Wine Package is unsuccessful and needs to be re-sent to the Eligible Claimant, the Eligible Claimant will be responsible for any costs associated with the additional attempts of delivery. The Promoter will not be responsible for any further delay if the Eligible Claimant is not home to accept delivery of the Wine Package.
Whilst TWE only uses reputable shipping partners, neither TWE nor the Promoter shall be liable for wine bottles and wine boxes damaged or broken during shipment.
The Eligible Claimant must redeem the Promo Code by 11:59pm (AEDST) on the expiry date noted in the email containing the Promo Code (three (3) months from the date of the email). Expired codes cannot be reissued or extended.
A Promo Code is not transferable and can only be claimed and redeemed from TWE by the eligible claimant who made an Eligible Purchase. A Promo Code cannot be exchanged or redeemed for cash or in any other manner, in whole or in part.
Once an Eligible Claimant redeems their Promo Code and selects their preferred wine, that selection cannot be changed.
If the total stock of any of the Wine Packages is depleted, TWE reserves the right to provide Eligible Claimants with an alternative replacement wine variety that is of equal quality and value. Eligible Claimants will not be entitled to any additional compensation in the event that an alternative replacement wine variety that is of equal quality and value is replaced to fulfil their claimed wine package.
Each Wine Package will not be delivered to anyone less than 18 years of age. If there is any doubt about the age of the recipient on delivery, the recipient will be required to produce an appropriate form of photographic ID. If the recipient is unable to produce appropriate ID, the Wine Package will not be able to be delivered.
Every valid claim received during the Claim Period will be awarded (1) of the following:
Spend a minimum of $2,000 in an Eligible Purchase and receive bonus 12 bottles of red or white wine to RRP value of $300;
Spend a minimum of $5,000 in an Eligible Purchase and receive bonus 24 bottles of red or white wine to RRP value of $600; or
Spend a minimum of $10,000 in an Eligible Purchase and receive bonus 36 bottles of red or white plus 12 bottles of sparkling wine to RRP value of $1,260.
Note: The bottles of wine included in each pack will be selected by TWE and may be substituted with an alternate wine to the same value based on availability.
The Promoter reserves the right, at any time, to verify the validity of claims and Eligible Claimant’s (including an Eligible Claimant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the claim process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
Incomplete or indecipherable claims will be deemed invalid.
Multiple claims are permitted, subject to the following: (a) only one (1) claim is permitted per Eligible Purchase; and (b) each claim must be submitted separately and in accordance with these Terms and Conditions.
Eligible Claimants must retain their original purchase receipt(s) for all claims as proof of an Eligible purchase. Failure to produce the proof of Eligible purchase for all claims when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of a claimant’s claims and forfeiture of any right to a reward. Purchase receipt(s) must clearly specify the store of purchase and that the purchase was made during the Purchase Period but prior to submitting the claim.
If there is a dispute as to the identity of an Eligible Claimant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Eligible Claimant.
The Promoter’s decision is final, and no correspondence will be entered into.
If for any reason an Eligible Claimant does not take / redeem a Wine Package by the time stipulated by the Promoter, then the Wine Package will be forfeited.
Eligible Claimants consent to the Promoter using their name, likeness, image and/or voice in the event they are a successful claimant (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any claimant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
Any cost associated with accessing the promotional website is the Eligible Claimant’s responsibility and is dependent on the Internet service provider used. The use of any automated software or any other mechanical or electronic means that allows a claimant to automatically claim repeatedly is prohibited and will render all claims submitted by that Eligible Claimant invalid.
The Promoter encourages consumers to enjoy alcohol responsibly. Legally aged consumers are advised to consider the safe drinking levels recommended in the National Health and Medical Research Council Australian Guidelines to Reduce Health Risks from Drinking Alcohol. Eligible Claimants will be refused service of alcohol or provision of a Wine Package if it would breach any relevant laws, codes or policies including those of TWE relating to the responsible service of alcohol.
TWE will supply and deliver Wine Packages to Eligible Claimants under South Australian liquor licence number 51403170.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in gift value to that stated in these Terms and Conditions; (e) any tax liability incurred by a claimant; or (f) use of a gift.
The laws of New South Wales apply to the promotion. By making a valid claim for a Wine Package, Eligible Claimants unconditionally submit to the jurisdiction of the courts there.
